I always think about the most heavily regulated industries and why we have the most problems with them: 1) Financial Industry: If you think they were ever deregulated in a meaningful way, you were misled. "the Mayflower Compact was in essence a social contract in which the settlers consented to follow the rules and regulations of the government for the sake of survival. The government, in return, would derive its power from the consent of the governed." I was researching on the Mayflower Compact and I find that last sentence pretty difficult to understand. So if anyone can please help give me briefly on what that phrase means. I'd appreciate that.

It seems as if corporations all have divisions that rely on multi million dollar government contracts and heavy legislation to prevent competition in several key basic needs markets . The only thing slowing ethanol production is regulatory prohibitions as with hydrogen production and facilities licensed to distribute it . Forget that auto manufacturers also build tanks trucks and government vehicles and will not make simple adjustments to make vehicles compatible with alternative fuels. . We also have strong subsidies in our food markets and strict trade agrements on clothing imports . Our electrical costs are regulated and access to the grid is restricted with only .002% of customers selling back energy to the grid . They talk a good game but when it comes right down to it free enterprise has been buried under government restrictions regulations and red tape . " Last week, the Financial Crisis Inquiry Commission kicked off their first round of hearings on the causes of the economic meltdown on Wall Street. The commission is being compared to the the Pecora Commission launched in 1932 to investigate the causes of the Great Depression. The Pecora commission is beloved by those who believe the solution to every problem is more laws because it was used to justify a number of new laws, including Glass-Steagall. Of course, none of those laws addressed the real causes of the Great Depression. It was the introduction of unsound monetary policy and central economic planning pursued by the Federal Reserve that really threw everything off balance. The Fed was founded in 1913 to stabilize the economy and prevent a recurrence of the short-lived Panic of 1907, but instead it promptly produced the Great Depression which lasted more than 15 years. The Pecora Commission was stacked with big government sympathizers who blamed the free market and the gold standard without question, and without any consideration of government interference in the economy. This panel is no different. Never will they contemplate how government steered us into this crisis, and what perverse incentives can be removed or repealed so that the market will function more smoothly. Never will they discuss how investment should come from savings, not debt. Never will it occur to them that fiat money, artificially low interest rates and the whole Federal Reserve System might be unwise and unstable, not to mention unconstitutional. The answer will always be more government regulation and oversight. It is predictable that this government panel will eventually come to the firm conclusion that government needs to be bigger, and that the market is just too free. How sad is this when exactly the opposite is true? It is big government that gives out tax breaks to engineer behavior, often creating large pockets of malinvestments. It is government that created the FDIC and the Fed as lender of last resort which all encourages moral hazard. It is big government that gives bureaucrats the ability to bail out cronies with taxpayer dollars while screaming that the economic sky is falling if they don’t. It is big government that every year adds new layers to the already labyrinthine regulatory code that smaller businesses can’t keep up with while simultaneously preventing new businesses from emerging. It is big government that misdirects economic productivity into bankrupt businesses that they consider to be too big to fail. If this panel was serious about understanding the root of the problem, as they claim to be, they would have people testify who understand the crisis and saw it coming. To my knowledge, none of them have received a phone call. The problem is those people would say too many things the government panel would find inconvenient. They would point fingers at too many of the state’s anointed. They would recommend getting government out of the way of the free market and getting back to simply protecting contracts and punishing fraud. But the biggest fraud is perpetrated by the Federal Reserve. No one on this panel takes that viewpoint seriously. Instead, they will be asking people who are still scratching their heads at how they could have missed the housing bubble what new regulations they can put in place to prevent future bubbles. Do anybody have experience with the required wireless equipment update by home security monitoring company? I subscribed to monitoring service with a Home Security Monitoring company. I have wireless security equipment installed. Recently they told me that the government require them to replace the analog radio tower system with digital radio tower system. This results in I need to replace my wireless security equipment as well, otherwise it won't be able to connect to the new radio tower. They charged me $100 for that. Since I'm still in a contract with them, I think I shouldn't pay that $100. So, do anybody have experience in this matter? Is the new regulation for real? Do you TRULY understand how bad the American Government is? They are right there with the Wall Street crowd. It doesn't matter if you are a Rep or a Dem, they both do this. Recently, Prez Obama talks about getting jobs for our Disabled Veterans (DV). The Veteran's Administration (VA) has a program called, "Service-Disabled Veteran-Owned Small Business" (SDVOSB). The program SOUNDS interesting and easy, but it is far from it! This is so these companies can bid on set-aside government contracts (set-aside contracts are those that are set-aside for SDVOSM, women owned businesses, 8(a) companies, etc.). So, the rules say, you must have a DV owning 51% of the business and ACTIVELY running the business. So, how many DV's leave the military with the knowledge of how to run their own business? How many know how to put bids together for a contract? How many know that, in order to get a government contract, you must be bonded and insured and to get that, you have to have CAPITAL! How much capital? Well, typically, you get one-third the money on your bond for what you have in capital. As an example, if you have $1 million dollars in capital, you are lucky to receive a bond of $300,000! There's not too many contracts that are that low. So, think about all of this for a minute, is it any wonder why the VA did not meet their quotas for the number of SDVOSB's last year? And you would THINK the VA is there to HELP the DV, right? YOU WOULD BE WRONG!! So, you may be thinking, well, I'll just join up with a General Contractor, who already owns his own business, and use him to help me, right? Sounds logical, right? Well, you can't do that because the Small Business Administration (SBA) has a rule call "Affiliation", which you are not allowed to have. The funniest part of this is their definitions of "Affiliation"...here's two items: 13 C.F.R part 121.103: (4) Affiliation may be found where an individual, concern, or entity exercises control indirectly through a third party. (5) In determining whether affiliation exists, SBA will consider the totality of the circumstances, and may find affiliation even though no single factor is sufficient to constitute affiliation. "...and MAY FIND affiliation even thought NO SINGLE FACTOR is sufficient to constitute affiliation"??? What? Why don't they just say, "Look, if we do not want you to have a company, we'll just fall on this rule and then you CAN'T have it!" This is what many of us American's are saying when you hear us talk about TOO MUCH REGULATIONS! I ask the financial insitutions why should this group qualify? No job, already in debt with student loans, etc., and here they are preying on this group. By the time the student realizes they made a bad deal, their more in debt. Giving money to U.S. citizens as Congress proposed yesterday is a very BAD idea! They are just enabling the problem even more. If you want to fix the economy, regulation of financial institutions MUST be mandated. Limits on interest rates-10%, no hidden fees, a contract less than 1 page long, etc. TIME TO GET TOUGH ON THESE LOAN SHARKS!!!!!
At what point does the government regulating marriage cross the line? Inspired by facade's answer to my earlier question: 'I think you started out talking about relationships, but then took a swerve and mentioned something about a legally binding government-issued contract instead. So, to summarise: Relationships based on mutual love, trust, and respect: Good. Government contract regulating your relationship and finances: Bad.' This seems to be what a lot of the MRAs on here would like, if taken to the extreme. What do you think can you please scrutinze this? Resolved that an unjust government is more desirable than no government. I agree that an unjust government is more desirable than no government. I will offer the following definitions. According to New World Dictionary it defines unjust, "as unfair." Another word to clarify is desirable which is defined, "as worth wanting or being useful.” Government is defined as exercising authority over a state such as a district, organization or an institution. To some, the idea of forcing everyone to accept the same leader is unjust. Since all governments do this, all governments are unjust. My value is order, according to the definition in general, order is a rule of being or of conduct, established by an authority able to enforce its will; a controlling regulation; the mode or order according to which an agent or a power acts. Without order you have chaos. With chaos liberty is impossible. For a government to operate effectively there must be order. Order translates to laws or rules of the land and laws are needed to provide liberty. My criteria use is the social contract, which it is a theory that is used to explain the relationships of the people and the government. The idea of social contract is that the citizens agree to be governed by the government and in return the government is obligated to provide order for its citizens. Hillary Clinton Unveils Food Safety Plan Following the largest beef recall in our nation’s history, Hillary Clinton highlighted a series of food safety proposals she would pursue as President. This recall is not an isolated case – it is yet another troubling reminder that our food supply is at risk. Each year, tens of millions of Americans contract food-borne illnesses every year; hundreds of thousands are hospitalized; and thousands die. And the risks are only growing. Last year alone, the U.S. Department of Agriculture (USDA) oversaw 21 recalls related to E. coli in meat, compared with just eight in 2006. One of those recalls involved more than 20 million pounds of ground beef that caused nearly 100 illnesses in the United States and Canada. In addition, yesterday’s recall by Hallmark/Westland is the second-largest supplier to the U.S. School Lunch program and a substantial supplier to other federal food and nutrition initiatives. Hillary believes that American families should not have to worry about the safety of food on their dinner tables or in their children’s school lunches. That is why she has proposed common-sense – and long-overdue – food safety reforms, building on her work in the Senate. As President, she will: Immediately conduct a thorough audit of our nation’s food safety systems to locate weaknesses and gaps. The current recall raises a number of questions, including how USDA failed to detect violations at the Hallmark/Westland plant and what steps USDA will take to ensure that all of the meat is removed from grocery stores and school cafeterias. Hillary will seek a report with recommendations on immediate and long-term reforms. Increase USDA food safety funding by more than 50% so that our inspectors have the resources and staffing they need to do their jobs. USDA conceded that the cattle involved in this recall “did not receive complete and proper inspection.” This year, USDA’s Food Safety and Inspection Service will have a budget of $930 million. Much of that money goes to fund 7,800 inspectors responsible for inspecting 6,200 slaughterhouses and food processors across the nation. Hillary will move over time to increase that budget to $1.5 billion and to bolster the inspection force. Move toward a single Food Safety Administration responsible for all food products, with strong authorities to protect consumers. Hillary will work to centralize our nation’s food safety efforts in one agency, so that multiple bodies are not policing imports and setting separate standards. Right now, 15 agencies administer more than 30 laws related to food safety. The result is overlap, gaps, and waste. At times, our system is downright bizarre. For example, a ham and cheese sandwich on one slice of bread is the responsibility of the USDA. But a ham and cheese sandwich on two slices of bread is the responsibility of the Food and Drug Administration (FDA). Hillary believes that the current regulatory system is broken and that we can only meet the challenges we face through a single agency that uses a uniform system of tracing and inspection to ensure the highest standards of safety and quality from food’s origin to it consumption. Give our safety agencies mandatory recall authority and direct them to create a national tracing system so we can determine the origin of tainted food. Hillary will authorize the FDA and USDA to mandate recalls of tainted products. Right now, the FDA and USDA lack mandatory recall authority. And the Government Accountability Office has found that current food recall systems have additional severe flaws: (1) FDA and USDA are often unaware of how promptly and completely companies carry out recalls; (2) FDA and USDA do not promptly confirm that recalls have made it all the way down the distribution chain; and (3) public notification procedures are often ineffective. Hillary will direct the new food safety agency to address these shortcomings. She will also direct the new food safety agency to establish an integrated national traceback system to help regulators trace food products and ingredients from their point of sale back to their origin. At present, there are gaps in our ability to determine the source of unsafe food and animal feed, which hinders efforts to control outbreaks and curb them before they spread. We must ensure that we have adequate tracking and monitoring mechanisms in place to ensure the health of our livestock, our farmers and our consumers nationwide. Find, prosecute, and punish food production facilities that abuse animals and allow unsafe food to enter our food supply. Hillary will strengthen safety rules and increase civil and criminal penalties for violations of federal food safety regulations. She will direct federal prosecutors to aggressively crack down on offending companies. Part of ensuring that we have a safe food supply is making sure sick and injured animals are humanely euthanized, not slaughtered and put into the food supply. Twelve of the 15 cases of mad cow disease in North America were linked to downed animals. Downed animals are also three times more likely to carry E. coli, and according to one analysis presented at the American Meat Institute conference, 14% of downed cows carried salmonella. After the mad cow disease scare in 2003, the USDA put in place a temporary ban of the slaughter of downer animals, but a 2006 investigation by the USDA Inspector General revealed that the ban has not been well enforced and that more than two dozen downed animals were allowed into the food supply over a nine-month period. Americans need to have confidence in our meat suppliers, and the current temporary ban must be made permanent. Any airline with headquarters in your state would have to leave unless they want to be considered a foreign carrier, and thus follow the restriction imposed by the FAA regarding this issue. The budget lays the foundation for a government takeover of the health care and energy sectors and dramatically increasing spending across the board, other than defense weapons programs. Spending as a percentage of the economy under this budget will reach the historic level of 27.7 percent this year. The deficit as a percent of the economy, at 12.3 percent, is set to be the biggest in the entire history of the country outside of the four peak years of World War II. Anyone who offers such a budget can only fairly be described as a believer in bigger government.
Are the people of Cardiff aware of the high risk of cholera? Zimbabawe has a major cholera epidemic which despite lies from Mugabe is out of control. Due to hundreds of Zimbabwean refugees & asylum seekers coming into the City of Cardiff and spread throughout its various communities and due to Welsh Refugee Council and Cardiff Council Asylum Support Team totally failing in their duties to maintain links with health care providers for their clients the residents of Cardiff are at serious risk indeed. As well as overcrowding accomodation to reap more revenue per head which is paid directly to various private landlords from allocated government funding ( Lynx Hotel Newport Road grossly overcrowded and well outside of fire regulations ) there are other dire problems such as rat and mice infestations and fire hazards. These are evident in and around the many grubby run down privately owned houses and flats which are sublet under contract to the Home Office and supposedly managed by the agencies I am identifying here. But most worrying of all is the fact that absolutely nothing is being done to ensure clients are seen by doctors or hospitals. This is the responsibility of the Welsh Refugee Council and the accomodation providers under Cardiff Council namely the Asylum Support Team. All they are interested in is being seen to be performing within the remit of their contract looking after their own jobs and maximising rents paid from government funds to the landlords who are making thousands from the scheme. As soon as any rents are no longer forthcoming countless sick refugees and asylum seekers are being put onto the streets within seven days of payments ceasing. The staff at WRC and the Council Asylum Team will adamantly try to cover their own backs and claim that they "signpost" clients to services which simply doesnt happen and many of these vulnerable and sick people are wandering around in Cardiff and its suburban communities. Many are made homeless by huge flaws in the system which unseen by the public is in a disgraceful mess. Therefore a high risk of Cholera now exists. After countless efforts to inform these agencies of details and evidence of the above problems which are just being ignored it is now cause for alarm for all residents of Cardiff. You would not believe the lack of interest and the lethargic attitude of staff at these agencies. Does freedom imply that you have choices avaiable and if those choices become limited are you still free .? What you can do is go into thousands of dollars of debt getting an education designed only to prepare you to work for others . If you do have the financial resources to start a business you are forced to comply with numerous state and federal regulations and laws .Permitting , licensing , unemployment insurance , property taxes , sales taxes , income taxes , and taxes paid on the raw materials along with Insurance required by state law to operate your business . How anyone manages to be successful is amazing . But given those who do succeed it is in large part due to government contracts .Yes you must work for uncle sam to be profitable . Every major U.S. business has a division that does work for Uncle Sam almost .Unless you make office furniture and even then a line of government office furniture is needed to succeed . Supreme court did it rigth : reverse criminalized retail price agreements ? Good? Look at the circumstances that gave rise to the decision. A company called Leegin Creative Leather had a no-discount policy that came with its decision to sell to Kay's Kloset. Kay's didn't honor that policy, so when it came time for a new deal, Leegin said no deal. Kay's complained that the refusal of Leegin to sell hurt their business, which was all about a particular leather line that Leegin made. The courts ruled against Leegin, slapping them with a $1.2 million fine. In fact, the government was telling Leegin that it is a slave to regulation: it had to sell regardless of whether contracts on the other end were honored or not. Folks, this is not free enterprise. Finally the Supreme Court agrees. It's not often I can say it, so enjoy: the Supreme Court did the right thing. It has reversed a century-old rule that criminalized retail price agreements. Good. Great. There are 10 million bad regulations to go. Now, if you just happen to be reading over the Constitution, you will note that it does not give government power to tell manufacturers what the price of their products should be, or to regulate the terms of the contracts, much less provide a rationale for economy-wide price controls. In fact, if you were reading it for the first time, you might find the assertion that such a power exists to be preposterous on its face. Truly it is. The Constitution gives the federal government no power to regulate the details of economic contracts. Now, is retail price maintenance a good practice or a bad one? Every producer wants the highest possible price, but it too faces a competitive marketplace. To maintain a high price in the face of expanding competition isn't always a good idea. Downward pressure must sometimes be dealt with. So it might not be a good decision to enforce these types of agreements. But the real question is: who is to decide? Should it be the government or the contracting parties? When the contracting parties decide, no one is hurt because all transactions, including those made by final consumers, are voluntary. When the government is involved, at least one party and sometimes several are compelled against their will to engage in transfers of property without their consent. Even if consumers benefit, it wouldn't matter: one group is winning at another's expense, which isn't the market way. The good news here is that this ruling will have an immediate impact on the marketplace. Producers might start to offer deeper discounts on their products. This way, retailers can save money in other aspects of their business. It could result in some restructuring that will benefit everyone from workers to consumers. It's true that the marketplace has found workarounds to these rules in the past, but not without the high cost of regime uncertainty. There is a broader point here about the Constitution. Clearly the federal government has no legal authority to be legislating or ruling on this subject at all. It is not only the regulation on retail price maintenance that is unconstitutional but the whole of the Sherman Antitrust Act, which, incidentally, is surely one of the most anachronistic pieces of economic legislation on the books. Should all abusive credit card products be banned or all credit cards? In light of the fact that I and evidently many others have been abused by credit card products when a payment was missed by jacking the rates up to an unfordable can never repay rates. Should just these products be banned or should government regulations be put on these companies to allow each credit card holders penalties be set at a maximum per year, per mo. or a percentage of their income . We have all had a missed payment for various reasons. With the open ended contracts allowed by our government over the last 7 years we can be penalized financially the rest of our lives. Not only with the jacked rate but dammage to credit report. SHOULD THE GOVERNMENT PUT A LIMIT ON HOW MUCH THE CREDIT CARD COMPANIES CAN PENALIZE US? SRC50 must own stock in the credit companies. Some presidential nominees claim they have a plan for all our problems??? I liked this article by Ron Paul. Called "I have a plan..." As election time nears, we are bombarded with political ads and speeches by candidates telling us their great plans for running the country. At the end of the recent presidential debate, for example, the Democratic nominee recited a litany of supposed cures for nearly everything that ails us, beginning each sentence with the phrase “I have a plan…” The problem is that government is not supposed to plan our lives or run the country; we are supposed to be free. That our public discourse strays so far from this principle is an unhappy sign of our times. Those who believe in limited constitutional government should worry every time a politician says, “I have a plan.” Remember, there is a simple dictionary definition for government planning of the production and provision of goods and services: socialism. No matter how much the grand planners from both political parties deny it, many of their programs and proposals are socialist. Federal taxes, regulations, welfare, subsidies, wage controls, price controls, and interest rate manipulations all represent socialist interventions in the economy. True, we do not yet have a fully socialist economy. But that is why we must be vigilant and label socialist proposals for exactly what they are, so we can maintain and expand economic freedom in America. Both history and economic theory prove conclusively that centrally-planned economies lower the standard of living for everyone except government elites. Historically, centralized economic planning goes hand in hand with hardship and bloodshed. Modern soft socialism, found in nations like Sweden and France, is beginning to implode of its own weight as governments realize they simply cannot fund cradle-to-grave programs without imposing tax rates that kill any last remnants of productive spark in their citizens. By contrast, capitalism – which is to say economic freedom – raises the standard of living for everyone in a society. But we must understand what capitalism really is. Capitalism is not a system, but rather the result of free individuals taking economic actions without interference by government. A true capitalist economy is neither planned by bureaucrats nor steered by regulators. This is why it’s so important that we resist the idea that any president should plan our economy. If we accept that government “runs” the economy, we accept a fundamental tenet of socialism. We must understand that economic liberty is every bit as important as political and civil liberties. In a truly free nation, the government acts only as a referee by protecting property rights, enforcing contracts, prohibiting force and fraud, and providing national defense. Such was the system envisioned by the Founding Fathers, who strictly limited regulatory and tax powers in the Constitution. They were tired of having their business affairs managed by the Crown, so they created a servant government that would allow freedom and capitalism to flourish. Today’s political rhetoric demonstrates that the servant has become the master. Most politicians, and too many Americans, have accepted the premise that government should plan our lives and control the economy. This subservient mindset encourages political pandering, as candidates strive to convince voters of their superior plans to take care of all of us. What Happened to America? In the last fifty years, we have grown accustomed to governments whose policies on specific issues may be good or bad, but which essentially institute incremental changes to the status quo. The major exceptions have been Thatcher and Reagan, but even their programs of dismantling systems of social welfare seem, in retrospect, mild compared to what is happening in the United States under George Bush – or more exactly, the ruling junta that tells Bush what to do and say. It is unquestionably the most radical government in modern American history, one whose ideology and actions have become so pervasive, and are so unquestionably mirrored by the mass media here, that the population seems to have forgotten what “normal” is. George Bush is the first unelected President of the United States, installed by a right-wing Supreme Court in a kind of judicial coup d’etat. He is the first to actively subvert one of the pillars of American democracy: the separation of church and state. There are now daily prayer meetings and Bible study groups in every branch of the government, and religious organizations are being given funds to take over educational and welfare programs that have always been the domain of the state. It is the first administration to openly declare a policy of unilateral aggression, a “Pax Americana” where the presence of allies (whether England or Bulgaria) is agreeable but unimportant; where international treaties no longer apply to the United States; and where – for the first time in history – this country reserves the right to non-defensive, “pre-emptive” strikes against any nation on earth, for whatever reason it declares. It is the first – since the internment of Japanese-Americans in World War II – to enact special laws for a specific ethnic group. Non-citizen young Muslim men are now required to register and subject themselves to interrogation. Many hundreds have been arrested and held without trial or access to legal assistance-- a violation of another pillar of American democracy: habeas corpus. The Financial Times of England, hardly a hotbed of leftists, has categorized this economic policy as “the lunatics taking over the asylum.” But more than Reagan – whose policies tended to benefit the rich in general – most of Bush’s legislation specifically enriches those in his lifelong inner circle from the oil, mining, logging, construction, and pharmaceutical industries. At the middle level of the bureaucracy, where laws may be issued without Congressional approval, hundreds of regulations have been changed to lower standards of pollution or safety in the workplace. Billions in government contracts have been awarded, without competition, to corporations formerly run by administration officials. In a country where the most significant social changes are enacted by court rulings, rather than by legislation, the Bush administration has been filling every level of the complex judicial system with ultra-right ideologues, especially those who have protected corporations from lawsuits by individuals or environmental groups, and those who are opposed to women's reproductive rights. Most of all, America doesn’t feel like America any more. The climate of militarism and fear, similar to any totalitarian state, permeates everything. Bush is the first American president in memory to swagger around in a military uniform, though he himself – like all of his most militant advisers – evaded the Vietnam War. (Even Eisenhower, a general and a war hero, never wore his uniform while he was president). In the airports of provincial cities, there are frequent announcements in that assuring, disembodied voice of science-fiction films: “The Department of Homeland Security advises that the Terror Alert is now . . . Code Orange.” Every few weeks there is an announcement that another terrorist attack is imminent, and citizens are urged to take ludicrous measures, like sealing their windows, against biological and chemical attacks, and to report the suspicious activities of their neighbors. The Pentagon institutes the “Total Information Awareness” program to collect data on the ordinary activities of ordinary citizens (credit card charges, library book withdrawals, university course enrollments) and when this is perceived as going too far, they change the name to “Terrorist Information Awareness” and continue to do the same things. Millions are listed in airport security computers as potential terrorists, including antiwar demonstrators and pacifists. Critics are warned to “watch what they say” and lists of “traitors” are posted on the internet. The war in Iraq has been the most extreme manifestation of this new America, and almost a casebook study in totalitarian techniques. First, an Enemy is created by blatant lies that are endlessly repeated until the population believes it: in this case, that Iraq was linked to the attack on the World Trade Center, and that it possesses vast “weapons of mass destruction” that threaten the world. Then, a War of Liberation, entirely portrayed by the mass media in terms of our Heroic Troops, with little or no imagery of casualties and devastation, and with morale-inspiring, scripted “news” scenes – such as the toppling of the Saddam statue and the heroic “rescue” of Private Lynch. Finally, as has happened with Afghanistan, America has received very little news of the chaos that has followed the Great Victory. It is very difficult to speak of what is happening in America without resorting to the hyperbolic cliches of anti-Americanism that have lost their meaning after so many decades, but that have now finally come true. Perhaps one can only recite the facts, and I have mentioned only some of them here. This is, quite simply, the most frightening American administration in modern times, one that is appalling both to the left and to traditional conservatives. This junta is unabashed in its imperialist ambitions; it is enacting an Orwellian state of Perpetual War; it is dismantling, or attempting to dismantle, some of the most fundamental tenets of American democracy; it is acting without opposition within the government, and is operating so quickly on so many fronts that it has overwhelmed and exhausted any popular opposition. Perhaps it cannot be stopped, but the first step toward slowing it down is the recognition that this is an American government unlike any other in this country’s history, and one for whom democracy is an obstacle.
Did my employer act within their rights in regards to this contract ? I was recently employed as a "Christmas casual" at a local specialty store, in New South Wales. The contract, which both me and the employer signed, indicated that the contract was until the 31st of January. After my first shift, I checked the roster and realised that none of the Christmas causals were rostered on during January. So I asked the manager if I could have some shifts in January. She responded with a flat no, with the reason being that they were switching back to their normal rosters and were therefore not rostering any of us on. However, a couple of weeks after that I noticed that three of the ten girls who had been hired using the same contract as mine had been given shifts during January. None of our names initially appeared in the January roster. Also, in the contract there is no mention of a maximum number of hours, however one of the other Christmas causals offered me her two shifts during one week as she had secured another job (lucky girl!). When I went to confirm the swap with the manager I was flatly informed that I wasn't allowed to take those shifts, as I could only work a maximum 25 hours in one week. However, at the initial training night she told us that according to government regulations we could work a maximum of 38 hours in any one week. I know that casuals usually get the short end of the stick in terms of rosters, but I am curious to know, is this a violation of the contract? I didn't have the guts to ask these questions to her face, as I don't like being the workplace whinger, but this sort of thing has never happened in any other place of employment I have been in. I was always informed when I started "you will get shifts up to date x, and that's it", where date x was the last week in the contract, and I have never heard that the maximum number of hours I can work was 25. So I am rather curious to know if this is within her rights. Sorry if I was unclear, I was illustrating that I have never had this problem before. In my other places of employment, the employers have been clear what sort of hours to expect before either of us sign. In all cases I have been asked to do more shifts as they arose, and that was great for me. This was not the case here, so I was suprised and somewhat bemused at the sudden change.

BUSH, President of the United States of America, find that, due to the unusual and extraordinary threat to the national security and foreign policy of the United States posed by acts of violence threatening the peace and stability of Iraq and undermining efforts to promote economic reconstruction and political reform in Iraq and to provide humanitarian assistance to the Iraqi people, it is in the interests of the United States to take additional steps with respect to the national emergency declared in Executive Order 13303 of May 22, 2003, and expanded in Executive Order 13315 of August 28, 2003, and relied upon for additional steps taken in Executive Order 13350 of July 29, 2004, and Executive Order 13364 of November 29, 2004. I hereby order: Section 1. (a) Except to the extent provided in section 203(b)(1), (3), and (4) of IEEPA (50 U.S.C. 1702(b)(1), (3), and (4)), or in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted prior to the date of this order, all property and interests in property of the following persons, that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of United States persons, are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in: any person determined by the Secretary of the Treasury, in consultation with the Secretary of State and the Secretary of Defense, (i) to have committed, or to pose a significant risk of committing, an act or acts of violence that have the purpose or effect of: (A) threatening the peace or stability of Iraq or the Government of Iraq; or (B) undermining efforts to promote economic reconstruction and political reform in Iraq or to provide humanitarian assistance to the Iraqi people; (ii) to have materially assisted, sponsored, or provided financial, material, logistical, or technical support for, or goods or services in support of, such an act or acts of violence or any person whose property and interests in property are blocked pursuant to this order; or (iii) to be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked pursuant to this order. (b) The prohibitions in subsection (a) of this section include, but are not limited to, (i) the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order, and (ii) the receipt of any contribution or provision of funds, goods, or services from any such person. Sec. 2. (a) Any transaction by a United States person or within the United States that evades or avoids, has the purpose of evading or avoiding, or attempts to violate any of the prohibitions set forth in this order is prohibited. (b) Any conspiracy formed to violate any of the prohibitions set forth in this order is prohibited. Sec. 3. For purposes of this order: (a) the term "person" means an individual or entity; (b) the term "entity" means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization; and (c) the term "United States person" means any United States citizen, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States. For those persons whose property and interests in property are blocked pursuant to this order who might have a constitutional presence in the United States, I find that, because of the ability to transfer funds or other assets instantaneously, prior notice to such persons of measures to be taken pursuant to this order would render these measures ineffectual. Any spouses feel penalized by ARMY housing and pcs dates being altered due to stop loss? I feel as if I had rejoined the army when he signed up since there are regulations placed on spouse movement (i.e., hubby gets deployed for 12mos-18 mos. and you're only "allowed" to leave your government housing overseas for a max of 30 days without him losing a section of his pay called BAH. Fine, I understand that. Pls. ship my household goods back to america from germany so I can complete myde gree bc there's nothing worthwhile to beaccomplished in 30 days (smaller post have limitations on course offerings, i.e, no science w/ labs 2 complete a r.n. prog); But if I leave and when he returns I can NOT be command sponsored again UNLEss he has 3yrs left on contract! So i either bend over and take the shaft in one of x ways:1) EROD (early return of dependents) and not be able to afford to stay in europe on our own w/ his salary (which btw he could be making min $160k/yr as a civ. arabic speaker and not deal w/ this) when he returns for the rest of his 18 mos. left on contract. 2)stay and don't do anything to complete my degree till the iraq fiasco is over (post doesn't have courses higher than gen ed that I need 2 complete a r.n. prog) 3)Hope he gets a duty station close to where I live (in n. ca/the houston area) even though the distance from either place would be a min. of a 5 hr. drive since we've both agreed to not add a single day to his contract. 3)perhaps you'll see why I'm so reluctant for him to sign up and he has seen the light as well. I'm due shortly., his unit COULD let him stay for 2 wks. after their deployment so he could see the kid (they've done it before for 2 others), but new ldrshp + unit change has allowed paperwork to get lost/whatever...only answer he gets is they're unsure when they could get a decision about that. In addition to that, everyone in his unit has had the proposed leave of their max 4 wks. before deploying for over a year cut to 2 wks. AND THE ARMY WONDERS WHY PPL DON'T EASILY REENLIST THESE DAYS??!?!!?
What if Blackwater USA turns into a renegade christian army? I was reading about Blackwater USA today, and it scared the hell out of me. A megarich fundie called Erik Prince has his own army of mercenaries that he sub-contracts to the Bush administration for use both internationally and in the states (the were used after hurricane Katrina and are currently in Iraq). The benefit for the Bush administration is that these guys aren't bound by the same rules and regulations the military have. ie: They don't have to justify there actions to anyone but their employer. Aside from the obvious appalling aspects of this, is it a concern that Blackwater could start to develop it's own agenda and take unilateral action without even being contracted to the US government? Would it be fair to call them a fundamentalist army?
